Track warrants its Outdoor Stadium Product Line-Models 4550, 4551, 4552, and 4553 with the Fast Track Finishes Program to successfully perform under normal use and service for the following duration:
All Warranties are granted to the original end customer for the original installation; are non-transferable; duration is measured from shipment date and become effective upon payment in full. In no event shall Track Seating be liable in either tort or contract for any loss or direct, special, incidental, consequential or exemplary damages. This warranty does not convey any rights to the original purchaser or to third parties to collect for losses due to product’s or Track Seating’s non-performance for loss of use or other damages. Installation labor originally contracted with Track Seating will be warranted for one year. Track Seating reserves the right to perform or source all warranty work during this year. After this one year period the warranty is in effect for materials only and exclusive of shipping and installation cost. After one year it is the original purchaser’s responsibility to remove product in question for return to Track Seating. This warranty does not imply the product mentioned here-in is suitable for any application than originally designed and makes no other warranties, expressed or implied, other than those set forth here-in. The purchaser and their agents have the sole responsibility to judge suitability for use and compliance with all applicable codes, etc. No installer, dealer, agent, or employee of Track Seating has the authority to modify the obligation of this warranty. This warranty shall not include replacement induced by acts of God, vandalism, flood, fire, calamity, or abuse. Manufacturer reserves the right to alter any or all materials, designs, processes, specifications and warranties as it sees fit. |
